Quattrocchi extradition: CBI crosses first hurdle



Buenos Aires:The CBI has managed to cross the first hurdle in its attempt to get Italian businessman and Bofors accused Ottavio Quattrocchi extradited from Argentina.

The basis for their claim to extradite Quattrocchi has been declared up to the mark.

The team handed over the 250-page long dossier to the Argentine foreign office. The papers are on their way to the lower court of El Dorado in Misiones.

Defence arguments

The matter will probably go before the court of Judge Mariana Arjol who had denied Quattrocchi bail the first time around.

Once the papers reach the judge, both parties will be given five days to send their respective documents after which a hearing will be held within 15 days.

Quattrocchi's defence team says part of their arguments will focus on the fact that according to Argentine laws, extradition cannot be granted in a case which has already undergone trial anywhere else, in this case Malaysia.

"That will be one of the aspects of our defence. The other will focus on the two Delhi High Court judgements," said Allejjandro Freeland, Q's lawyer.

CBI sources have admitted to NDTV that although they are bound to include the two very damaging Delhi High Court judgements, which dismissed the bribery and corruption charges, they say they have only included the 'relevant' portions.

Sonia to address CPP

The good news for both parties is that according to lawyers, extradition cases go directly from the lower court straight to the Supreme Court.

This means that this process may be settled much quicker than it took to settle Abu Salem's extradition case.

Congress President Sonia Gandhi will address the first general body meeting of the Congress Parliamentary Party on Tuesday.

There is speculation on whether she will touch upon the Ottavio Quattrocchi controversy.

This is the first meeting after the detention in Argentina of the controversial Italian businessman, a prime accused in the Bofors payoffs case.
